"SEC Pursues Inquiry into Terraform Labs Co-founder Daniel Shin's Involvement in South Korea"
The US Securities and Exchange Commission (SEC) has been granted permission to seek assistance from South Korea in questioning Daniel Shin, one of the co-founders of Terraform Labs, a blockchain company. The SEC is building a case against Terraform Labs and another co-founder, Do Kwon. District Judge Jed Rakoff approved the SEC's motion on August 16, allowing them to question Shin and request documents related to Chai Corporation, a payments provider in South Korea that he founded.
The SEC's interest lies in investigating the relationship between Chai Corporation, Terraform Labs, and Terra blockchain. They want to understand Do Kwon's role at Chai Corporation, how Chai utilized the Terra blockchain, and the accuracy of Chai's disclosures about its ties to Terraform. The SEC is also seeking information about the separation of Chai Corporation from Terraform Labs, as the two companies were initially closely connected, sharing offices and staff before splitting in 2020.
Terraform Labs and Do Kwon did not oppose the SEC's motion. They also included their own set of questions and document requests, and they have previously denied the SEC's allegations.
The SEC had filed a lawsuit against Terraform Labs and Do Kwon in February, accusing them of fraudulent activities involving Terra's cryptocurrencies, particularly TerraClassicUSD (USTC) and Terra Luna Classic (LUNC). The SEC alleged that Kwon and Terraform Labs falsely claimed that Chai Corporation was using the Terra blockchain for processing and settling transactions. The SEC also accused them of fabricating transactions involving TerraKRW (KRT), a stablecoin pegged to the Korean won, to create the illusion that Chai was utilizing the blockchain.
Terra's crypto ecosystem collapsed in May 2022, causing significant financial losses, and affecting the broader cryptocurrency market. In April of a previous year, South Korean prosecutors charged Daniel Shin with multiple fraud charges for allegedly concealing the risks associated with investing in Terraform's cryptocurrencies.
Do Kwon is currently serving a four-month prison sentence in Montenegro for attempting to leave the country using a counterfeit Costa Rican passport. He faces criminal charges in both the United States and South Korea, and both countries have requested his extradition.
